An oilfield equipment company in Texas, Dragon Rig Sales and Service, and its parent company, The Modern Group, have agreed to pay $35,000 to settle a disability discrimination lawsuit filed by the EEOC. The lawsuit alleged that Dragon Rig denied a job offer to an applicant because he used prescription medications to treat anxiety and opioid use disorder. Even though the applicant passed the company's drug screening, they withdrew the offer based on assumptions about the medications, without ever discussing potential accommodations with the applicant. The EEOC considers this a violation of the Americans with Disabilities Act (ADA) which protects qualified individuals with disabilities from discrimination in employment. The settlement includes financial compensation for the applicant, as well as mandatory training for company management and revisions to company policies to prevent similar situations in the future.
